Buying cannabis seeds online in Virginia: the federal rules

Under the federal law in force today (the 2018 Farm Bill), cannabis seeds with no more than 0.3% delta-9 THC have been treated as hemp, as the DEA said in informal letters in 2022. A new federal hemp definition takes effect on December 11, 2026, unless Congress delays it again, and it excludes viable seeds from plants above 0.3% total THC. Regulators have not yet said how they will apply it to seeds. Once a seed germinates, state law decides whether you may grow it. Read the federal section of our US guide.

Growing season and climate in Virginia

Virginia's coastal plain and Piedmont have long, humid summers, and frost there usually holds off until late October or later. The Shenandoah Valley and the mountains of the southwest are cooler, with frost possible by early to mid October. Late-season remnants of tropical storms can bring several days of rain right at harvest, so mold is a real risk. Growers in the east can run later strains, while those in the mountains should favour earlier ones.

Quebec Cookies and Durban Poison suit the long eastern season, with Quebec Cookies being mold tolerant, and Super Critical finishes in time for the cooler mountain valleys.

  • Quebec Cookies – bred by QCS, 70% sativa, 19–25% THC, ready late October outdoors, tolerant of common pests and mold
  • Durban Poison – pure sativa, about 18% THC, ready mid-October outdoors
  • Super Critical – bred by QCS, 60% indica, ready late September to early October outdoors

Harvest dates and THC figures are ranges from our strain pages, not promises: results depend on the grower, the method and the season’s weather.
