Are cannabis seeds legal in the USA?
Short answer: under the federal law in force today, cannabis seeds have been treated as hemp, but a new federal definition taking effect on December 11, 2026 changes that for seeds from high-THC plants, and every state has its own rules for growing.
- Today: the 2018 Farm Bill defines hemp as the cannabis plant “including the seeds thereof” with no more than 0.3% delta-9 THC. In 2022 the DEA said, in informal letters, that cannabis seeds meeting that limit are hemp and not a controlled substance. Once a seed germinates, the plant is treated like any other cannabis plant.
- Coming change: a law signed in November 2025 redefines hemp by total THC (including THCA) and excludes “viable seeds” from plants that exceed 0.3% total THC. Most of the new definition takes effect on December 11, 2026, unless Congress delays it again. Regulators have not yet said how they will apply it to seeds.
- Marijuana itself remains a Schedule I controlled substance under federal law, except state-licensed medical marijuana and FDA-approved products, which moved to Schedule III in April 2026.
- State law decides home growing. 24 states and Washington, D.C. allow adult-use cannabis, and 20 of those states plus D.C. let adults grow at home, some with conditions.
Cannabis seed and home-grow laws by state
The table shows, for each state, whether adults can buy cannabis for recreational use and whether they can grow it at home. Laws change often: this table was last checked on October 26, 2026. Always confirm your state’s current law before you germinate seeds. This is general information, not legal advice.

The best cannabis seeds for your US climate
The United States has every kind of growing season, from Alaska to Florida. The figures on each strain page are ranges, not promises: harvest dates and yields depend on the grower, the method and the season’s weather.
Northern states and short summers
Plants that finish by mid- to late September beat the first frosts and the cold fall rains, from Maine and Vermont to Michigan, Minnesota and Montana.
- Quebec Early Bud – bred by QCS, mid-September outdoors
- Early Hash Skunk – ready in September outdoors
- SFV OG Fast Version – mid-September outdoors
- Super Critical – bred by QCS, late September to early October
Long, warm seasons
Where the outdoor season runs into late October (much of the South and the West Coast), longer-flowering strains have time to finish.
- Durban Poison – pure sativa, mid-October outdoors
- NYC Diesel – sativa-dominant, late October outdoors
- Quebec Super Skunk – bred by QCS, October outdoors
Humid regions
In the humid Southeast, Gulf Coast and Northeast, airflow and pruning matter most. A mold-tolerant strain helps, but no strain is immune to mold.
- Quebec Cookies – bred by QCS, tolerant of common pests and mold
Indoors, balconies and discreet grows
Autoflowers stay compact and flower on their own, whatever the light schedule, so they suit tents, closets and small spaces in any state.
- Northern Lights Autoflower – bred by QCS, compact, 90% indica
- All autoflower seeds
Why US growers buy from Quebec Cannabis Seeds
Quebec Cannabis Seeds has sold cannabis seeds since 2015 and breeds many of its own strains in Quebec, Canada, such as Quebec Early Bud, Super Critical, Quebec Cookies and Quebec Super Skunk. Strains selected for a short northern season are a good match for the northern half of the United States. Read about our breeding program, our shipping policy and our FAQ.
